Terms of Use (Terms & Conditions) for Daily Journal & Wisdom: WiseOn

1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Simplify Apps Studio ("Company", "we", "us", or "our"), governing your access to and use of the mobile application Daily Journal & Wisdom: WiseOn ("the App"), including any associated software, services, features, and content.

By downloading, installing, accessing, or using Daily Journal & Wisdom: WiseOn, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease using the App and uninstall it from your device.

2. Eligibility & User Accounts

A. Age Requirement

You must be at least 13 years of age (or the minimum legal age required in your country/jurisdiction to consent to digital services) to use WiseOn. If you are under 18 years of age, you represent that you have reviewed these Terms with your parent or legal guardian and that they consent to these Terms on your behalf.

B. Account Registration & Security

• Account Types: You may use the App anonymously or register an account using Email/Password, Google Sign-In, or Sign in with Apple.
• Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Accuracy: You agree to provide accurate and complete information when registering an account and to update your information promptly if it changes.

3. License & Acceptable Use

A. Limited License Grant

Subject to your compliance with these Terms, Simplify Apps Studio grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable limited license to download, install, and use WiseOn for your personal, non-commercial journaling and self-reflection purposes on devices that you own or control.

B. Prohibited Conduct

You agree that you will not:

1. Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or derive source code from any portion of the App.
2. Circumvent, disable, or interfere with security features or access controls of the App (including journal vault biometric locks or paywall gating).
3. Use the App for any illegal, unauthorized, fraudulent, or harmful purpose under local, state, national, or international laws.
4. Upload, generate, store, or transmit any content that is unlawful, defamatory, harassing, abusive, hateful, obscene, or infringes upon third-party intellectual property rights.
5. Use automated bots, scrapers, or scripts to access or extract data from the App or servers.
6. Attempt to overload, flood, or disrupt the operation of our servers, cloud storage, or infrastructure.

4. User Content & Intellectual Property Rights

A. Your Content Ownership

You retain 100% ownership of all content that you create, write, draw, capture, upload, or store in WiseOn, including your text journal entries, handwritten doodles, sticky notes, custom stickers, photos, and location memory tags ("User Content").

B. License Granted to Simplify Apps Studio

To enable us to provide the App's services (such as syncing your memories across devices, rendering scrapbook layouts, and maintaining secure cloud backups via Firebase), you grant Simplify Apps Studio a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, format, and display your User Content solely for the purpose of operating, maintaining, and providing the App's features to you. We will never sell or publicly distribute your private journal entries.

C. Responsibility for User Content

You are solely responsible for your User Content. You represent and warrant that you own or possess all necessary rights and permissions to use and upload any media, photos, or graphics added to your journal.

5. Subscriptions, Purchases & Payment Terms

A. Free & Pro Features ("WiseOn Pass")

WiseOn offers both free features and paid premium features (such as WiseOn Pass / Pro), which grant access to unlimited journal memories, advanced custom sticker studios, premium journal themes, and exclusive daily prompt packs.

B. In-App Purchases & Billing

• All paid transactions, subscriptions, and single purchases are billed securely through the Google Play Store or Apple App Store (managed via Superwall).
• Prices for subscriptions are displayed in the App prior to purchase and may vary by region or currency exchange rates.

C. Auto-Renewal

• Paid subscriptions automatically renew at the end of each billing cycle (e.g., monthly or annually) unless auto-renewal is turned off or cancelled at least 24 hours before the end of the current billing period.
• Your Google Play or Apple App Store account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate.

D. Subscription Management & Cancellation

You can manage, alter, or cancel your subscription at any time through your device's store settings:

• Android: Google Play Store -> Tap Profile Icon -> Subscriptions.
• iOS: Settings -> Tap Apple ID -> Subscriptions.
  Uninstalling the App does not automatically cancel your active subscription.

E. Refund Policy

All purchases are final and non-refundable, except as expressly provided by the refund policies of the Google Play Store or Apple App Store, or as required by applicable law in your jurisdiction.

6. App Intellectual Property & Trademarks

The App—including its source code, UI/UX designs, hand-drawn graphics, brush algorithms, page-curl animations, theme assets, soundscapes, "Wiseman / Caveman" prompts, branding, logos, and trademarks—is the exclusive intellectual property of Simplify Apps Studio and its licensors, protected by copyright, trademark, and intellectual property laws.

Except as expressly authorized in Section 3, nothing in these Terms grants you any right, title, or interest in or to the App's intellectual property.

7. Important Disclaimer: Not Mental Health or Medical Advice

IMPORTANT NOTICE:

Daily Journal & Wisdom: WiseOn is designed solely as a personal self-reflection, journaling, and creative scrapbooking tool for entertainment and productivity purposes. The daily wisdom prompts, mood tags, and quotes provided in the App do not constitute medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment.

If you are experiencing severe emotional distress, anxiety, depression, or a mental health crisis, please consult a qualified healthcare professional or contact a certified crisis helpline in your country immediately.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

SIMPLIFY APPS STUDIO SPECIFICALLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• UNINTERRUPTED, ERROR-FREE, SECURE, OR VIRUS-FREE APP OPERATION.
• ACCURACY, RELIABILITY, OR COMPLETENESS OF DAILY PROMPTS, LOCATION DATA, WEATHER STAMPS, OR CLOUD SYNCHRONIZATION.

YOU ASSUME TOTAL RESPONSIBILITY FOR BACKING UP YOUR MEMORIES AND JOURNAL DATA.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SIMPLIFY APPS STUDIO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNATIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR JOURNAL CONTENT.
• DATA LOSS RESULTING FROM HARDWARE FAILURE, SYSTEM WIPES, OR INTERNET DISRUPTIONS.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO SIMPLIFY APPS STUDIO FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $50.00 USD, WHICHEVER IS GREATER.

10. Termination & Account Cancellation

• Termination by You: You may stop using the App at any time and delete your account or wipe your journal data directly via Settings -> Account -> Delete Account or Settings -> Memory Management -> Wipe Journal Data.
• Termination by Us: We reserve the right to suspend, disable, or terminate your access to the App immediately and without prior notice if we determine, in our sole discretion, that you have violated any provision of these Terms or engaged in unauthorized or illegal activity.
• Effect of Termination: Upon termination, your right to use the App will immediately cease, and your User Content stored in our servers may be permanently deleted in accordance with our Privacy Policy.

11. Privacy Policy

Your privacy is important to us. Our collection, use, and disclosure of your personal information and permissions are governed by our Privacy Policy, which is incorporated into and forms an integral part of these Terms.

12. Modifications to the Terms or Service

We reserve the right to update, modify, or revise these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this document and provide notice within the App or via release notes. Your continued use of WiseOn following the posting of updated Terms constitutes your binding acceptance of the changes.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Simplify Apps Studio operates, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved through good-faith negotiation, or in the competent courts of the developer's jurisdiction.
